Selling a tenant-occupied rental property in California is one of the most legally complex real estate transactions you can undertake. California's tenant protection laws are among the strongest in the country, and missteps can result in lawsuits, delays, and significant financial penalties.

Your Options for Selling a Tenant-Occupied Property

Option 1: Sell with the tenant in place. This is the simplest approach. You sell the property to a buyer who accepts the existing tenancy. The tenant's lease transfers to the new owner. This works well for investors who want a turnkey rental property.

Option 2: Wait for the lease to expire, then sell vacant. If the tenant has a fixed-term lease, you must wait until it expires. Month-to-month tenants can be given notice to vacate (with proper just cause under AB 1482 if the property qualifies).

Option 3: Negotiate a buyout with the tenant. Many tenants will agree to vacate early in exchange for a cash payment (relocation assistance). This is often the fastest and least contentious approach.

California's Just Cause Eviction Requirements

Under AB 1482 (Tenant Protection Act of 2019), most California landlords cannot evict tenants without "just cause" after the tenant has lived in the property for 12 months. Just cause includes non-payment of rent, lease violations, and owner move-in (with restrictions). Simply wanting to sell the property is NOT just cause for eviction.

The Owner Move-In Exception
